There is hereby established a board to be known as the Protection

Subject to subsections (1B) and (2) where it appears

Review by Board
Any applicant aggrieved by any decision of the Commissioner
under
ion 16 may in writing--
request the Commissioner to give reasons for that decision; and
after being given reasons under paragraph (a),
request the
issioner to refer the application to the Board.
Upon receiving a request from an applicant under subsection (1)
(b),
Commissioner shall forward all documents relating to the
application

The Board may confirm or vary any decision of the Commissioner
on an

Additional power of Commissioner
Notwithstanding that in any particular case a petition referred
to in
ion 16 (1) (a) (i) or (b) has not been presented against an
employer,
Commissioner may, subject to subsection (2) of that section,
make an
ratia payment under that section in that case if in his opinion--

Where the Commissioner exercises his discretion under
subsection (1)

For the purpose of verifying any application under section 15,

各区、县(市)人民政府,市政府各委、办、局:
经市政府同意,现将哈尔滨市金融工作领导小组办公室制定的《哈尔滨市农户及中小企业小额信贷管理办法》予以转发,请认真贯彻实施。

第一章 总 则
第一条 为切实解决农户和中小企业融资困难,加快社会主义新农村建设,促进区、县(市)经济持续、快速、健康发展,特制定本办法。
第二条 小额信贷是整合各区、县(市)政府组织优势、商业银行的资金优势和担保中心的风险分担优势,向各区、县(市)农户和中小企业提供小额有偿有息的信贷资金,以帮助农户和中小企业实现可持续发展的一种信贷方式。
第三条 小额信贷以区、县(市)域经济为重点,以农户和中小企业为对象,金融系统及财政、发展改革、农业等部门应密切合作,各司其职,推动小额信贷业务健康、有序开展。
第二章 组织推进机构与职责
第四条 市政府金融工作领导小组办公室(以下简称市金融办)负责协调推进全市小额信贷工作,各区、县(市)政府、市商业银行和市民营企业担保中心要成立相应的推进小额信贷业务的机构,配备人员,确保业务上的协调与配合。
第五条 市金融办的主要职责:
(一)制订全市小额信贷总体实施方案,拟订小额信贷有关规定及管理办法等。
(二)组织对小额信贷进行政策调研,总结交流经验。
(三)宏观指导和监督检查各区、县(市)政府和有关部门贯彻执行有关小额信贷的方针、政策,小额信贷业务工作和各项规章制度的执行情况,按季度通报区、县(市)农户和中小企业贷款推荐及担保、贷款发放情况,监督检查担保基金的使用情况。
第六条 各区、县(市)政府的主要职责:
(一)将一定数量的财政资金存入市民营企业担保中心,作为开展小额信贷业务的担保基金来源之一。各区、县(市)的担保金统一“打捆”使用,不受担保金出资额度限制,综合使用扩大倍数后的担保金,不单独核算各区、县(市)的担保金额度。各区、县(市)承担本区、县(市)小额信贷担保净损失额的50%。
(二)负责组建小额信贷融资服务中心,作为区、县(市)政府小额信贷的融资平台,依法提供农户及中小企业小额贷款的资源、信息及资金需求,建立企业、乡(镇)、村与市商业银行及市民营企业担保中心的联系,并负责协助市商业银行开展本区域内农贷信息员队伍的组建和管理。
(三)负责中小企业贷款项目的组织、融资中心推荐及贷款全过程的跟踪监督。区、县(市)融资服务中心对正常的中小企业贷款每3个月检查1次,并将检查情况书面通报给银行及担保中心;对逾期贷款每1个月检查1次,并将检查情况书面通报给银行及担保中心。
(四)利用各种媒体对小额信贷进行宣传,使农户及中小企业了解小额信贷的相关政策和规定。
(五)在农户、中小企业贷款项目的组织、推荐及贷款全过程中,不得收取服务费用。
第七条 市商业银行的主要职责:
(一)根据全市担保能力和信用情况,授予一定期限的小额信贷综合授信额度。
(二)按照担保基金放大倍数向符合条件的农户及中小企业提供小额信贷融资服务。其中,对大额农户贷款按照专户存储担保基金的6倍发放贷款,对中小企业贷款按照专户存储担保基金的5倍发放贷款。
(三)负责确定小额信贷业务的经办行。其中,农贷经办行为阿城管辖行和利民管辖行,中小企业贷款经办行为霞曼支行。
(四)为农户及中小企业提供项目融资、财务咨询和市场营销策划增值服务。
第八条 市民营企业担保中心的主要职责:
(一)建立覆盖各区、县(市)的担保网络体系,为市商业银行发放的大额农户贷款和区、县(市)推荐的中小企业贷款提供担保。
(二)提高担保基金的放大倍数。其中,对大额农户贷款的担保按担保金的6倍予以担保;对中小企业的担保按担保金的5倍予以担保。
(三)承担小额信贷担保净损失额的50%。
(四)负责将各区、县(市)的担保金及市政府的配比资金存入指定账户,并保证上述担保金专项用于本办法规定的项目。
第三章 农户贷款
第九条 农户贷款是指以农户为借款对象,针对农户在生产和经营过程中的资金需求而提供的快速人民币贷款。贷款可用于满足农户从事种植业、养殖业、农户服务业和购买农机具、农业科技项目等与农业相关的生产经营所产生的资金需求。按照贷款金额划分,农户贷款分为贷款额超过1000元、不超过5万元的小额农户贷款和贷款额超过5万元、不超过50万元的大额农户贷款。
第十条 借款人的基本条件:
(一)在贷款发放地有固定住所、有当地常住户口(或有效居住证明),具有完全民事行为能力,身体健康的自然人。
(二)年龄在18周岁以上,借款人年龄加借款人期限不超过65岁(含)。
(三)具有一定的种植、养殖和农户服务经验。
(四)无赌博、酗酒等不良嗜好,遵纪守法,没有违法、违纪行为。
(五)收入稳定,具有归还贷款本息的能力。
(六)家庭和睦、劳动能力较强。
第十一条 小额农户贷款的金额、期限、利率、担保及还款方式:
(一)贷款额度:小额农户贷款额度起点为1000元(含),原则上不超过5万元(含)。
(二)贷款期限:贷款期限最长不超过2年(含),根据农户所需资金的实际情况具体确定贷款期限。
(三)贷款利率:小额农户贷款利率根据市场情况及中国人民银行的相关规定执行。
(四)贷款的担保方式:小额农户贷款采取5户农户联保的担保形式,不需要市民营企业担保中心提供担保。
(五)贷款的还款方式:贷款期限在1年以内的可以采取利随本清的还款方式或根据农户实际需要选择其他的还款方式;贷款期限在1年以上的需采取分期还款的方式。
第十二条 大额农户贷款的金额、期限、利率、担保及还款方式:
(一)贷款额度:对于从事各种特色小作坊的大额农户,贷款额度最高不超过30万元(含);对于从事大规模种植、形成规模小庄园的大额农户,贷款额度最高不超过50万元(含);对于从事小区养殖、集中养殖的大额农户,贷款额度最高不超过50万元(含);对于从事农业产业化、规模化经营的能手及公司,视其经营和担保情况确定贷款额度。
(二)贷款期限:贷款期限最长不超过2年(含),根据农户所需资金的实际情况具体确定贷款期限。
(三)贷款利率:农户贷款实行优惠利率,贷款利率上浮幅度不超过基准利率的40%。
(四)贷款的担保方式:大额农户贷款由市民营企业担保中心提供连带责任保证,担保费费率为1%/年。农户向市民营企业担保中心提供反担保,反担保的形式包括:5户联保;土地抵押;房产抵押;“五荒地”抵押;土地经营权质押等。
(五)贷款的还款方式:贷款期限在1年以内的可以采取利随本清的还款方式或根据农户实际需要选择其他的还款方式;贷款期限在1年以上的需采取分期还款的方式。
第十三条 小额农户贷款的操作流程:
(一)市商业银行指定专业支行,派驻工作人员
市商业银行下设农贷中心负责农贷业务,并向各区、县(市)派驻专门的工作人员,与当地政府共同合作开展农贷业务。
(二)确定贷款发放的乡(镇)、村(屯)
由各区、县(市)政府配合市商业银行确定发放贷款的乡(镇)、村(屯),并明确各乡(镇)、村(屯)的农贷负责人,配合市商业银行开展农贷业务。
(三)贷前调查
在各村农贷业务具体负责人的配合下,市商业银行工作人员开展贷前调查工作。主要了解借款人的基本情况、担保情况、还款能力等方面的信息,确定贷款的发放额度。
(四)贷款发放
贷款审批后,市商业银行与各地农贷负责人确定贷款发放的时间和地点,进行现场统一发放贷款。
(五)贷款的归还
各乡(镇)、村(屯)的农贷负责人根据市商业银行的通知,组织农户按照指定的时间、地点和方式归还贷款。
第十四条 大额农户贷款的操作流程:
(一)借款申请人向区、县(市)融资服务中心提出担保申请。
(二)区、县(市)融资服务中心每月定期汇总大额农户需求后,统一报市民营企业担保中心。
(三)市民营企业担保中心在落实反担保措施的基础上,向市商业银行出具贷款担保函。
(四)市商业银行对大额农户贷款实行“即保即贷”模式,凡市民营企业担保中心出具担保函的,随即办理发放贷款手续。
第四章 中小企业贷款
第十五条 中小企业贷款是指以各区、县(市)的中小企业为借款对象,针对企业生产经营过程中的资金需求而提供的贷款。贷款包括流动资金贷款和临时性周转资金贷款。
第十六条 借款人的条件。借款人为具有独立法人资格的中小企业,应同时具备以下条件:
(一)有经工商行政管理部门年检的营业执照(特殊行业应提供特殊行业经营许可证),原则上总资产在5000万元以下,独立核算、自负盈亏、具有持续正常经营能力。
(二)有组织机构代码证和中国人民银行核发的贷款卡。
(三)原则上资产负债率不超过60%,经营活动现金流量大于零。
(四)经营活动合法,符合国家产业政策和市商业银行信贷支持原则,最近2年没有违法违约经营记录及重大民事、经济纠纷。
(五)主营产品有市场、有效益、有信誉。
(六)具有还款能力和还款意愿。
第十七条 贷款金额、期限及利率:
(一)贷款金额:中小企业贷款额度起点为50万元,上限为1000万元(含1000万元)。
(二)贷款期限:流动资金贷款期限为1年(含1年)以内,临时周转贷款最长期限不超过6个月(含6个月)。
(三)贷款利率:贷款利率上浮幅度不超过基准利率的40%。
第十八条 借款申请人须提供的书面文件:
(一)借款申请书和借款担保申请书(包括借款用途、金额、期限、还款来源、还款方式、反担保措施、借款人声明等)。
(二)经年检的营业执照(特殊行业需提供特殊许可证)。
(三)组织机构代码证、税务登记证、开户许可证、贷款卡。
(四)法人代表身份证及户口复印件和个人简历。
(五)借款企业章程或股东出资协议、联营协议。
(六)财务报表、验资报告。
(七)反担保有关证件。
(八)市商业银行和市民营企业担保中心需要的其他资料。
第十九条 贷款的担保:市民营企业担保中心为借款人提供担保,借款人向市民营企业担保中心提供反担保,担保费率1%-1.5%/年之间。
第二十条 反担保种类:包括房产抵押、土地使用权抵押、通用设备抵押、企业(第三者)信用保证、股权质押、股权联保质押等。以股权、股权联保质押方式提供反担保的贷款采取以下操作流程:
(一)贷款企业(含联保企业)与市民营企业担保中心签订“反担保质押合同”后,出质方所在企业将全部股权在哈尔滨股权登记托管中心集中登记托管,同时申请办理股权质押。
(二)登记托管中心受理委托,完成股权登记托管后,为企业出具股东名册并发放股权证持有卡,并向工商行政管理部门查询出质人股权及所在企业情况,确定符合质押要求后,对所质押股权予以锁定。
(三)托管中心向质押双方出具《股权质押锁定通知书》,并向市或区、县(市)工商行政管理部门送达《股权质押通知书》,工商局受理后予以备案,并出具《股权质押备案通知书》。
(四)股权质押担保合同自在登记托管中心质押锁定之日起生效。
第二十一条 中小企业贷款操作流程:
(一)借款申请人向所在区、县(市)小额信贷融资服务中心申请担保、贷款推荐函。
(二)各区、县(市)组建的小额信贷融资服务中心负责中小企业贷款项目的组织筛选和推荐。
(三)各区、县(市)融资服务中心经过筛选同意的贷款,向企业开具“担保、贷款推荐函”。
(四)借款人持小额信贷融资服务中心开具的“担保、贷款推荐函”分别向市民营企业担保中心和市商业银行霞曼支行提出担保、借款申请。
(五)市商业银行霞曼支行与市民营企业担保中心的工作人员根据“担保、贷款推荐函”受理借款人的申请,并对企业进行联合贷款调查。
(六)贷款经分别审批同意后,由市民营企业担保中心向市商业银行出具担保函,市商业银行向借款人发放贷款。
(七)贷款经审批未通过的,由受理方及时向各区、县(市)融资中心和企业进行反馈。
第五章 风险管理及代偿机制
第二十二条 小额信贷实行“通报制”和“备案制”。
(一)市金融办按季度将农户和中小企业贷款的发放情况、贷款质量及工作中存在的问题等通报至各区、县(市)。
(二)市民营企业担保中心每月将农户和中小企业贷款的担保数据以书面形式通知各区、县(市)政府,予以备案。
(三)各区、县(市)发放的农户和中小企业贷款不良率超过一定比率后,停止在该地区发放新的农户贷款。
第二十三条 各区、县(市)小额信贷融资服务中心应协助市商业银行、市民营企业担保中心加强贷后管理,对企业生产经营出现异常或潜在风险的,要及时向市商业银行、市民营企业担保中心反馈。
第二十四条 当贷款出现逾期时,市商业银行应在贷款逾期的7日内,通知市民营企业担保中心、各区、县(市)小额信贷融资服务中心,三方共同催收,直至问题解决。
第二十五条 不良贷款的代偿方式、方法及时限按照市商业银行与市民营企业担保中心签订的《贷款担保合作协议》统一执行。
第六章 奖励与惩罚
第二十六条 建立小额信贷目标管理责任制。目标管理与贷款发放规模、还款率、回收再贷率和贷款的效益挂钩,实行市对各区、县(市),各区、县(市)对乡(镇)、村的层层量化考核办法。
第二十七条 对实施小额信贷目标管理责任制成效显著的区、县(市)、乡镇,市政府将给予一定奖励。
第七章 附 则
第二十八条 本办法自下发之日起执行,由市金融办负责解释。
